TERMS OF SERVICE
Last updated: August 14, 2026
OVERVIEW
Welcome to Novel of the Cross!
Novel of the Cross is operated by Xenon L.L.C., doing business as Novel of the Cross. The terms "we," "us," and "our" refer to Novel of the Cross.
Novel of the Cross operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Novel of the Cross is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access the Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you are the age of majority and have given your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing information, payment information, shipping address, and other contact information.
You represent and warrant that all information you provide through the Services is accurate, current, and complete and that you have all rights necessary to provide such information.
You are solely responsible for maintaining the security of your account credentials and for all activity associated with your account. You may not transfer, sell, assign, or license your account to another person.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to display and describe our products as accurately as possible.
However, colors, textures, print appearance, sizing, and other product characteristics may appear differently depending on your device, screen settings, lighting conditions, manufacturing processes, materials, and normal production variations.
Many Novel of the Cross products are produced or customized after an order is placed.
We do not guarantee that the appearance of a product on your device will exactly match the physical product you receive.
Minor differences in color, print placement, sizing, texture, or appearance that are reasonably associated with manufacturing, printing, materials, or display settings do not necessarily constitute a defect.
Please review all product descriptions, product images, and size charts carefully before placing an order.
Product descriptions, prices, specifications, availability, designs, colors, and other information may be modified without notice.
We reserve the right to discontinue any product at any time and to limit quantities or availability by person, household, geographic region, or jurisdiction where permitted by law.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase products from Novel of the Cross.
We reserve the right to accept, reject, limit, or cancel an order where permitted by law, including in cases involving suspected fraud, payment issues, pricing or product errors, inventory or production issues, shipping restrictions, or other legitimate business reasons.
An order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfillment.
Please review your order carefully before submitting it, including the selected product, size, color, quantity, design, and shipping information.
Because many of our products are made or customized after an order is placed, changes and cancellations are not guaranteed once an order has been submitted. Once production or fulfillment has begun, we may be unable to modify or cancel the order.
If we cancel an order for which payment has already been collected, we will issue any refund required in connection with that cancellation.
Your purchases are subject to our Return & Refund Policy:
Except as provided in our Return & Refund Policy or required by applicable law, all sales are final.
We do not accept returns, exchanges, or issue refunds because of change of mind, buyer's remorse, incorrect size or color selection, fit or style preference, or other reasons unrelated to a qualifying product defect, fulfillment error, or other circumstance covered by our Return & Refund Policy.
You represent that products purchased through the Services are intended for lawful personal or household use unless we have expressly authorized another use.
SECTION 4 – PRICES AND BILLING
Prices, discounts, promotions, and product availability may change without notice.
The price charged for a product will generally be the price displayed at checkout when your order is placed, subject to correction of obvious errors where permitted by law.
Applicable shipping charges, taxes, and other charges, if any, will be displayed during checkout when applicable.
We may offer promotions, discount codes, sales, or other offers from time to time. These may be subject to separate terms and may be modified or discontinued where permitted by law.
You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information for all purchases.
You represent and warrant that you are authorized to use any payment method provided and that the information supplied is accurate.
If an obvious pricing, product, or technical error affects an order, we reserve the right to correct the error and, where permitted by law, cancel the affected order. If payment has already been collected for an order that we cancel, the applicable amount will be refunded.
SECTION 5 – SHIPPING AND DELIVERY
Novel of the Cross currently ships to eligible addresses within the United States.
All production, fulfillment, delivery, and transit times displayed or communicated by Novel of the Cross are estimates unless expressly stated otherwise.
Production time and shipping time may be separate.
Orders may experience delays due to carriers, holidays, severe weather, transportation disruptions, incorrect customer information, unusually high order volumes, production issues, or other events outside our reasonable control.
If we become unable to ship an order within an applicable promised or legally required timeframe, we will handle the delay, cancellation, or refund as required by applicable law.
Once an order has shipped, tracking information will generally be provided when available.
Customers are responsible for providing complete and accurate shipping information when placing an order.
If you discover an error in your shipping information, please contact us as soon as possible. We cannot guarantee that an address can be changed after an order has entered production, fulfillment, or shipping.
Additional shipping charges may apply if an order must be resent because of incorrect or incomplete shipping information provided by the customer.
Risk of loss and title to purchased products will transfer in accordance with applicable law.
For additional information regarding production times, estimated delivery times, tracking, incorrect addresses, lost packages, damaged shipments, and returned packages, please review our Shipping Policy:
SECTION 6 – RETURNS, EXCHANGES, AND REFUNDS
Because many of our products are made to order, all sales are final except as expressly provided in our Return & Refund Policy or required by applicable law.
We do not accept returns or exchanges, and we do not provide refunds, for reasons including:
-
Change of mind
-
Buyer's remorse
-
Incorrect size selected by the customer
-
Incorrect color or product selected by the customer
-
Fit or style preferences
-
Minor variations in color, texture, print placement, sizing, or appearance that result from normal manufacturing or printing processes
-
Items that have been worn, washed, altered, or damaged after delivery
If an item arrives damaged, defective, misprinted, or materially different from the item ordered because of a fulfillment error, please contact us within the timeframe stated in our Return & Refund Policy and provide the requested documentation.
Depending on the circumstances and our Return & Refund Policy, an approved claim may result in a replacement or refund.
Do not return products to us or to any fulfillment location unless we specifically instruct you to do so.
Nothing in this Section limits any refund, cancellation, warranty, or other consumer right that cannot lawfully be excluded.
For complete terms, please review our Return & Refund Policy:
SECTION 7 – INTELLECTUAL PROPERTY
The Services and their contents, features, and functionality, including but not limited to text, artwork, designs, illustrations, photographs, product graphics, logos, trademarks, branding, videos, audio, page layouts, and other original materials, are owned by Novel of the Cross, Xenon L.L.C., our affiliates, licensors, or other applicable rights holders and are protected by applicable copyright, trademark, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only.
Except as permitted by law or with our prior written authorization, you may not reproduce, copy, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, sell, commercially exploit, store, or transmit protected materials from the Services.
Nothing in these Terms grants you ownership of or a license to any intellectual property belonging to Novel of the Cross, Xenon L.L.C., Shopify, or any third party except as expressly stated.
The Novel of the Cross name, logos, product names, artwork, designs, graphics, slogans, and other brand identifiers may constitute trademarks, copyrighted works, or other protected intellectual property of Novel of the Cross, Xenon L.L.C., their affiliates, licensors, or applicable rights holders.
You may not use such intellectual property in a manner that falsely suggests affiliation, authorization, sponsorship, or endorsement or otherwise infringes applicable intellectual property rights.
Shopify's name, logos, and trademarks belong to Shopify or their respective rights holders.
All other trademarks appearing through the Services belong to their respective owners.
SECTION 8 – OPTIONAL TOOLS
We may provide access to tools, services, applications, or functionality offered by third parties.
We may not monitor or control such third-party tools.
You acknowledge that access to third-party tools may be provided "as is" and "as available," subject to applicable law and to the terms and policies of the applicable third-party provider.
Your use of optional third-party tools is at your own discretion and risk.
You should review and understand the applicable third party's terms and privacy practices before using their services.
We may add new tools, functionality, services, and resources to the Services in the future. Unless otherwise stated, such additions will also be subject to these Terms.
SECTION 9 – THIRD-PARTY LINKS
The Services may contain links to, integrations with, or materials provided by third parties.
We do not control third-party websites and are not responsible for the accuracy, policies, products, services, security, or practices of third-party websites or services.
If you choose to access a third-party website or service, you do so subject to that third party's terms and policies.
Please carefully review the policies and practices of third parties before engaging in transactions with them.
Questions, claims, or concerns regarding products or services offered directly by third parties should generally be directed to the relevant third party.
SECTION 10 – RELATIONSHIP WITH SHOPIFY
Novel of the Cross is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are made directly with Novel of the Cross, not Shopify.
By using the Services, you acknowledge that Shopify is not the seller of products offered by Novel of the Cross and is not responsible for the performance of Novel of the Cross's obligations to you.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages, or liabilities arising solely from products purchased directly from Novel of the Cross.
SECTION 11 – PRIVACY POLICY
Personal information we collect through the Services is processed in accordance with our Privacy Policy:
Certain information may also be processed by Shopify in accordance with Shopify's applicable privacy policies.
Because our Services are hosted or supported by Shopify, Shopify may collect and process information relating to your access to and use of the Services in order to provide, maintain, secure, and improve its services.
Information provided through the Services may also be transmitted to and processed by service providers and other partners, potentially in locations outside your state or jurisdiction, as described in our Privacy Policy.
Please review our Privacy Policy for additional information regarding how personal information is collected, used, disclosed, and protected.
SECTION 12 – FEEDBACK AND USER CONTENT
If you voluntarily submit reviews, photographs, comments, ideas, suggestions, feedback, proposals, or other content relating to Novel of the Cross or the Services ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, display, and otherwise use such Feedback for lawful business purposes, including operating, improving, and promoting the Services.
You represent that you own or otherwise have sufficient rights to submit the Feedback and grant the rights described above.
You must disclose any compensation or incentive received in connection with a review or other Feedback where required by law.
You agree that Feedback will not violate any third-party copyright, trademark, privacy, publicity, or other legal right.
Feedback must not contain unlawful, defamatory, abusive, malicious, obscene, fraudulent, or harmful content or malware.
You may not impersonate another person or misrepresent the origin of Feedback.
We may moderate, edit, refuse, or remove Feedback where permitted by law.
SECTION 13 – ERRORS, INACCURACIES, AND OMISSIONS
Occasionally, information available through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, transit times, or other information.
Where permitted by applicable law, we reserve the right to correct errors, inaccuracies, or omissions and to update information.
If an error materially affects an order that you have already placed, we will handle the situation in accordance with applicable law.
SECTION 14 – PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
(a) violate any applicable law or regulation;
(b) infringe or violate our intellectual property rights or the rights of others;

(g) interfere with the security, availability, functionality, or operation of the Services;
(h) circumvent access controls, security measures, rate limits, robot exclusions, or other technical restrictions;
(i) scrape, extract, reproduce, copy, resell, or commercially exploit material from the Services without authorization except where applicable law expressly permits such activity; or
(j) use the Services in any manner that could damage Novel of the Cross, Xenon L.L.C., Shopify, other users, or third parties.
We may suspend, restrict, or terminate access to the Services if we reasonably determine that these Terms have been violated.
SECTION 15 – AUTOMATED SYSTEMS AND AGENTS
If you use automated software, artificial intelligence agents, bots, crawlers, scripts, or similar technology ("Agents") to access or interact with the Services, such use must comply with these Terms and applicable law.
Agents may not circumvent technical restrictions, CAPTCHAs, security controls, access controls, rate limits, robot exclusion mechanisms, or other measures intended to regulate access to the Services.
Agents must not falsely represent automated activity as human activity where identification is reasonably required.
We may restrict or prevent automated access to the Services at our discretion where permitted by law.
SECTION 16 – TERMINATION
We may suspend or terminate your access to all or part of the Services if you materially violate these Terms or where otherwise permitted by applicable law.
You remain responsible for obligations and amounts lawfully incurred before termination.
Any provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, limitation of liability, indemnification, governing law, and other accrued rights and obligations.
SECTION 17 – DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
EXCEPT FOR WARRANTIES THAT CANNOT LAWFULLY BE EXCLUDED, NOVEL OF THE CROSS AND XENON L.L.C. DISCLAIM EXPRESS AND IMPLIED WARRANTIES REGARDING THE SERVICES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, GUARANTEE, OR CONSUMER RIGHT THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SECTION 18 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOVEL OF THE CROSS, XENON L.L.C., AND THEIR AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR SIMILAR LOSSES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
THE FOREGOING LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
SECTION 19 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Novel of the Cross, Xenon L.L.C., Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, costs, and reasonable attorneys' fees arising from:
-
your material violation of these Terms;
-
your violation of applicable law;
-
your infringement or violation of the rights of another person; or
-
your unlawful or unauthorized use of the Services.
We will provide reasonable notice of an indemnifiable claim when practicable.
Nothing in this Section imposes obligations that cannot lawfully be imposed under applicable law.
SECTION 20 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or severed where necessary.
The remaining provisions will continue in full force and effect.
SECTION 21 – WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and other policies expressly incorporated by reference, constitute the agreement governing your use of the Services.
Nothing in this Section limits rights that cannot legally be waived.
SECTION 22 – ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.
We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, or other lawful business transaction, subject to applicable law.
SECTION 23 – GOVERNING LAW
These Terms of Service and any separate agreements through which we provide the Services will be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict-of-law principles, except where applicable consumer protection law requires otherwise.
Subject to applicable law, any legal proceeding relating to these Terms or the Services may be brought before a court of competent jurisdiction in Minnesota.
Nothing in this Section deprives a consumer of protections or rights that cannot lawfully be waived under applicable law.
SECTION 24 – HEADINGS
The headings used in these Terms are included for convenience only and do not limit or otherwise affect the meaning or interpretation of these Terms.
